A federal judge in North Dakota has ruled in favor of 19 states that challenged a federal rule allowing Deferred Action for Childhood Arrivals (DACA) recipients access to health care coverage through Affordable Care Act (ACA) plans.
The Centers for Medicare & Medicaid Services in May finalized a rule expanding access to health care coverage for DACA recipients through the health care marketplace, along with financial assistance through premium tax credits and cost-sharing reductions.
The judge’s ruling bars DACA recipients from enrolling in or getting subsidies for ACA plans in Alabama, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, and Virginia.
