Association Comments on Medicaid Tax Proposed Rule

In a July 14 letter to the Centers for Medicare & Medicaid Services (CMS), America’s Essential Hospitals responded to the agency’s proposal to add more requirements to determine whether taxes are uniformly applied. The association called on CMS to reevaluate this rule for clarity, as the rule uses vague and subjective standards that unintentionally could restrict legitimate uses of provider taxes.

Specifically, America’s Essential Hospitals urged CMS to:

  • Exclude hospital taxes from new restrictions
  • Remove subjective requirements that leave states without clear direction
  • Extend compliance deadlines
  • Ensure hospital payment rates are adequate regardless of how states finance their payments
