Administration Update: Medicaid Data Sharing Halted Further

America’s Essential Hospitals is closely monitoring the executive orders signed by President Trump since he took office on Jan. 20, as well as related lawsuits challenging the executive orders and other agency actions. The association will continue to provide monthly lawsuit updates and real-time summaries of executive orders and related agency actions. 

In response to a lawsuit against the departments of Health and Human Services (HHS) and Homeland Security (DHS) regarding Medicaid data sharing for immigration enforcement purposes, a California district court instructed HHS not to share any Medicaid data from the 20 suing states with DHS. The court also ordered DHS not to use any Medicaid data already received from plaintiff states for immigration enforcement purposes. Previously, HHS has shared personal data on Medicaid enrollees, including immigration status, to prevent immigrants without legal status from using public benefits. The order is in effect until the district court clarifies the scope of the preliminary injunction it granted in December 2025 as requested by HHS.
