The Centers for Medicare & Medicaid Services (CMS) proposed a remedy for nearly five years of unlawful Part B cuts to hospitals in the 340B Drug Pricing Program, including $9 billion in lump-sum Outpatient Prospective Payment System payments. The proposed remedy comes after America’s Essential Hospitals and other industry partners challenged the cuts in court and won a unanimous Supreme Court ruling in June 2022 that established the cuts violated the Medicare statute.
