On Sept. 17, the Department of Health and Human Service (HHS) and the Department of Treasury (DOT) released the final rule on the Affordable Care Act marketplace for plan year 2022.
The rule extends open enrollment, adds a new special enrollment period, expands navigator responsibilities, and modifies Section 1332 innovation waivers. Many finalized provisions were proposed in the July 2021 proposed rule, including:
- extending the annual open enrollment period for 30 days, from Nov. 1 to Jan. 15, on healthcare.gov;
- establishing a monthly special enrollment period for certain low-income individuals in marketplaces;
- expanding navigator services and duties; and
- increasing flexibility for states.
