DOL Issues New Guidance on Association Health Plans

The Department of Labor (DOL) has published new guidance on a final rule that established additional criteria for association health plans (AHPs).

The June final rule broadened the definition of “employer” under ERISA, paving the way for the expansion of AHPs.

The new guidance outlines the types of rules AHPs must follow under the Employee Retirement Income Security Act. The guidance also reiterates that states and the DOL have a joint responsibility to regulate AHPs, as well as the fiduciary responsibilities associated with the plans.
