CMS Temporarily Suspends IDR Process

The Centers for Medicare & Medicaid Services (CMS) briefly suspended the independent dispute resolution (IDR) process due to an Aug. 3 court decision that vacated the agency’s December 2022 fee increase and portions of the September 2021 rule on claims batching.

On Aug. 7, CMS directed certified IDR entities to resume processing single and bundled disputes where the administrative fees have been collected before Aug. 3. IDR entities also can resume processing batched disputes where eligibility was determined before Aug. 3. Processing other disputes remains temporarily suspended until CMS provides additional instructions.
