CMS Releases CoP Final Rule

The Centers for Medicare & Medicaid Services (CMS) released May 7 a final rule updating Medicare conditions of participation (CoP). In the rule, CMS finalized several proposals that America’s Essential Hospitals advocated for in its April 2013 comments on the proposed rule.

Of particular interest to our members, CMS finalized its proposal to rescind the requirement that a hospital’s governing body include a member of the medical staff. This requirement would have prevented some public hospitals from complying with state and local laws regarding public hospital governing boards. In addition, CMS revised its position that each hospital, including those in a multihospital system, have a separate and distinct medical staff. According to the final rule, hospitals within a multihospital system may choose to operate under a unified medical staff model.
