Hospitals and providers are eligible for alternate exclusions to measures in the public health reporting objective of the Medicare and Medicaid Electronic Health Record (EHR) Incentive Programs for the 2015 program year. According to a frequently asked questions (FAQ) document, the Centers for Medicare & Medicaid Services (CMS) says it did not intend to penalize providers for being unable to meet measures recently finalized in the meaningful use rule that were not previously required or unfeasible to implement in 2015.

Eligible hospitals can claim alternate exclusions for the public health objective in the following ways:

  • Hospitals scheduled to be in stage 1 must attest to at least two measures and can use an exclusion on any of the four applicable measures.
  • Hospitals scheduled to be in stage 2 must attest to at least three measures and can use an exclusion only on the Specialized Registry Reporting measure.

Eligible professionals (EPs) can claim alternate exclusions for the public health objective in the following ways:

  • EPs scheduled to be in stage 1 must attest to at least one measure and can use an exclusion on any of the three applicable measures.
  • EPs scheduled to be in stage 2 must attest to at least two measures and can use an exclusion only on the Syndromic Surveillance or the Specialized Registry Reporting measures.
