Association Comments on Notice of Benefit and Payment Parameters

In a letter to the Department of Health and Human Services (HHS), America’s Essential Hospitals commented on the proposed rule for Notice of Benefit and Payment Parameters for 2023. The rule establishes standards for issuers and marketplaces, as well as requirements for agents, brokers, web brokers, and issuers assisting consumers with enrollment through the Affordable Care Act marketplaces that use the federal platform for the 2023 plan year.

Based on these provisions, the association urged HHS to:

  • ensure equitable access to qualified health plan (QHP) beneficiaries’ preferred health care provider through essential care provider threshold requirements and network adequacy standards;
  • finalize the proposed changes to nondiscrimination policies that would prohibit discrimination based on sexual orientation and gender identity and ensure essential health benefits are based on clinical evidence;
  • standardize the collection of Z codes for QHPs; and
  • prorate premiums and advanced premium tax credits.
