Association Comments on 340B Ceiling Price, CMP Date Change

In a Nov. 20 letter to the Health Resources and Services Administration (HRSA), America’s Essential Hospitals urged the agency to promptly finalize its proposal to move up to Jan. 1, 2019, the effective and implementation date for a final rule on the calculation of ceiling prices for drugs purchased through the 340B Drug Pricing Program.

The final rule, which HRSA has delayed five times so far, also would impose civil monetary penalties (CMPs) for manufacturers who knowingly and intentionally charge covered entities more than the ceiling price for covered outpatient drugs.

America’s Essential Hospitals encouraged HRSA to provide covered entities access to 340B ceiling prices for covered outpatient drugs through a secure website as soon as possible.
