Statement on 340B Drug Pricing Program Proposed Rule on Ceiling Price and Civil Monetary Penalties

WASHINGTON—We are pleased that the Department of Health and Human Services (HHS) has responded to our lawsuit with other national organizations by proposing a Jan. 1, 2019, effective and compliance date for 340B Drug Pricing Program enforcement.

This change will put an end to the years-long delay of simple measures to hold drugmakers accountable in the 340B program. We encourage HHS to follow through with this proposal by promptly publishing a final rule in time to meet the new deadline.

The newly proposed regulation also calls on HHS to provide pricing information to 340B participating hospitals and other providers through a closed website. This website is essential to enforcement of the 340B program. We strongly encourage HHS to launch the website as soon as possible after Jan. 1, 2019.
