DOL Issues Guidance on Association Health Plans

A new Department of Labor (DOL) document provides clarity on how a recent court decision could affect association health plans (AHPs).

The United States District Court for the District of Columbia on March 28 ruled that a regulation expanding the availability of AHPs illegally circumvents the Affordable Care Act and violates the intent of federal insurance laws. DOL is considering all available options following the ruling, including an appeal.

The document advises AHP participants to contact their plan administrator to determine if their plan is affected by the decision, but notes that plans and health insurance issuers must keep their promises in accordance with their policies.

America’s Essential Hospitals in March 2018 commented on the proposed changes to AHPs, urging federal officials to ensure such plans have proper oversight and cover all necessary services for beneficiaries.
